This Privacy Policy describes how Heap Labs LLC, doing business as DealSpeak ("DealSpeak," "we," "our," or "us"), collects, uses, and shares information about you when you use our websites, applications, and services, including dealspeak.ai (collectively, the "Service"). DealSpeak is an AI-powered platform that provides voice-based sales-training simulations, coaching, and analytics for sales and service professionals. By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy.
If you use the Service through an organization, dealership, or employer (a "Business Customer") that purchased or provisioned access for you, please also see Section 13 ("Team and Business Customer Accounts"). In that context, your employer or organization administrator may control your account and access your practice-session data.

We do not use the content of your practice sessions to build advertising profiles about you, and we do not sell your personal information (see Sections 6 and 8).
The Service is designed for simulated practice: you speak with an AI-generated customer, not a live third party. To make this possible, your microphone audio is streamed in real time to our voice infrastructure and AI subprocessors, which convert your speech to text, generate the AI customer's responses, and convert those responses back into speech. This processing is described in Section 3.3. We store the resulting text transcripts and AI-generated outputs; live session audio is processed in real time by our voice subprocessors and is not retained as a stored recording by us.
The Service lets you upload or paste scripts, transcripts, or recordings — including material derived from real sales calls — to create or customize training scenarios. You are solely responsible for that content. You represent and warrant that you have obtained all consents and permissions required by applicable law (including any call-recording, wiretapping, and two-party consent laws) before uploading any recording or transcript that captures another person's voice or personal information. Do not upload recordings of real customers or third parties unless you are legally permitted to do so.
To deliver real-time voice conversations and AI features, we share the relevant audio, transcripts, and prompts with specialized third-party providers that process this data on our behalf, including:
These providers act as our service providers / processors and are permitted to use the data only to provide their services to us. A current list of subprocessors is available in Section 8 and by contacting us. We do not permit these providers to use your practice-session content to train their own foundation models except as needed to provide the Service to us; however, third-party providers operate under their own privacy terms, which we encourage you to review.
Payments and subscription billing are handled by Stripe, Inc.When you add a payment method, your card details are collected and stored by Stripe under Stripe's privacy policy. We receive and store limited billing metadata from Stripe (such as a customer identifier, subscription identifier, plan, subscription status, and partial card information like the last four digits and card brand) — we do not store your full card number. Your use of Stripe is subject to Stripe's Privacy Policy at https://stripe.com/privacy.
We use cookies and similar technologies to operate the Service, remember your preferences, keep you signed in, and understand how the Service is used. Where required by law, we ask for your consent before setting non-essential cookies through a cookie banner, and you can change your choice at any time using the "Cookie settings" link in our website footer.
We implement Google Consent Mode. If you are in a region where opt-in consent is required (such as the European Economic Area, the United Kingdom, or Switzerland), analytics and advertising storage default to "denied" and no analytics or marketing cookies are set until you accept them through our cookie banner. In other regions, analytics and marketing cookies are active by default and you can opt out at any time using the "Cookie settings" link in our website footer. Your choice is stored locally in your browser so we can honor it on future visits.

Where marketing cookies are permitted (see Section 5.2), we use the Meta Pixel, provided by Meta Platforms, Inc., to measure advertising effectiveness and reach relevant audiences. In regions requiring opt-in consent, the Meta Pixel does not load unless you accept marketing cookies; elsewhere you can turn it off via the "Cookie settings" link in our website footer. We do not sell your personal information for money, and we do not "share" it for cross-context behavioral advertising as those terms are defined under California law, except to the extent that use of advertising cookies (which you can decline) may be considered a "sale" or "share" under some laws. We implement appropriate technical and organizational measures designed to protect your personal information against unauthorized access, alteration, disclosure, or destruction, including encryption in transit, access controls, and hosting with reputable cloud infrastructure providers. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

We retain your personal information, including transcripts, recordings, and AI-generated outputs, for as long as your account is active and as needed to provide the Service, and thereafter for as long as necessary to comply with legal obligations, resolve disputes, prevent fraud and abuse, and enforce our agreements. Retention periods vary based on the type of data and the purpose for which it was collected. When we no longer need your information, we will delete or de-identify it. You may request deletion of your data as described in Section 10.

You will not be discriminated against for exercising your rights. If you access the Service through a Business Customer, we may direct your request to that organization or ask you to submit it through them, as they may act as the controller of your data.

The categories of personal information we collect are described in Section 1 and may include identifiers, account and commercial information, internet/network activity, approximate location (from IP address), and audio and other electronic information (voice recordings and transcripts). Voice recordings may be considered "sensitive personal information"; we use such information only to provide and improve the Service and for the purposes described in this policy, not to infer characteristics about you. We do not sell personal information for money. Our use of advertising cookies, which you can decline, may be considered a "sale" or "share" under California law; you can opt out through our cookie banner. If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process your personal information on the following legal bases: to perform our contract with you (to provide the Service); with your consent (for example, non-essential cookies and certain communications); to comply with legal obligations; and for our legitimate interests (such as securing, improving, and marketing the Service), provided those interests are not overridden by your rights.
The Service is operated from the United States, and your information will be transferred to, stored, and processed in the United States and other countries where our providers operate, which may have different data-protection laws than your jurisdiction. Where required, we rely on appropriate safeguards (such as the European Commission's Standard Contractual Clauses) for these transfers. By using the Service, you understand your information will be handled as described in this policy. You may also have the right to lodge a complaint with your local data-protection authority.
Where the Service is made available to you by a Business Customer (such as your employer, dealership, or organization), that organization administers your account and may access, monitor, and manage your account information and practice-session data (including transcripts, recordings, scores, and certification results) for training, coaching, and performance-management purposes. In that case, the organization is responsible for its own privacy practices and for providing any required notices to you, and it may act as the "controller" or "business" with respect to your information. We process such data on the organization's behalf as described in our agreement with them. Please direct privacy questions about your organization's use of the Service to your administrator.
The Service is intended for business use by adults and is not directed to children. You must be at least 18 years old to use the Service. We do not knowingly collect personal information from anyone under 18 (or under 13 within the meaning of the U.S. Children's Online Privacy Protection Act). If you believe a minor has provided us with personal information, please contact us and we will take steps to delete it.
We may update this Privacy Policy from time to time. We will post the updated policy on this page and revise the "Last Updated" date above. For material changes, we may provide additional notice (such as by email or an in-product notice). Your continued use of the Service after an update takes effect constitutes your acknowledgment of the revised policy.
